The results indicate that the flipped classroom encourages more active and meaningful learning, and is associated with higher motivation and better understanding on the part of students
2026-04-23T00:00:00+02:00 Copyright (c) 2026 Diego Aboi-Rubio https://reunido.uniovi.es/index.php/ridrom/article/view/24396 The Deductio ex Mercede as a Self-Help Remedy in the Balance of the Synallagma of the Locatio Conductio Insularum: Nature of the Legal Mechanism and Roman Law Related Considerations on Articles 1577 of the Italian Civil Code and 2694 of the Louisiana Civil Code 2026-04-02T11:54:56+02:00 Lorenzo Cimino l.cimino3@campus.unimib.it
The balance within the consensual obligation “locatio conductio insularum”, that is the one between the contractual duties “uti frui-mercedem” in late Republican Roman law and the early Imperial period, represents an “etiological dogma” of the contract itself. It imposes itself as the major key to interpreting the conduct of the parties during the execution of the contractual relationship. Emblematic in this sense is the figure of the deductio ex mercede in urban-residential leases, whose practical purpose allows for an exploration of its nature, reasons, limits, and development even up to contemporary law. Drawing on the continental – French and Spanish – derivation of the civil law of the State of Louisiana, through an analysis carried out from a Roman law perspective purely, this paper aims to highlight the characteristic of the deductio ex mercede as a self-help remedy, an instrument of “Offensive Selbsthilfe” which, although it does not find an equivalent in codified Italian – and continental – ius privatorum, seems to have bequeathed its authentic features to the “repair and deduct remedy” required and regulated by Article 2964 of the Louisiana Civil Code.
2026-04-23T00:00:00+02:00 Copyright (c) 2026 Lorenzo Cimino https://reunido.uniovi.es/index.php/ridrom/article/view/24137 The Widow as Legal Heir in Roman Law: Limits and Scope in Intestate Succession 2026-01-24T20:38:42+01:00 Laura Fernández Sánchez lfs38@alu.ua.es
Following the death of one of the spouses, the position of the surviving spouse in intestate succession became increasingly important as family and marital concepts evolved. In the specific case of widows, their inheritance rights evolved from archaic law, where the conventio cum manu defined their inheritance rights, to the reforms of the Praetor and Justinian, which consolidated reciprocal succession between spouses and the marital quarter to prevent them from losing their financial protection. This process and the introduction of specific protection mechanisms reflect the transition from a strictly vertical inheritance system to a more flexible and horizontal configuration, in which the marital bond acquires a legally relevant role.
2026-04-23T00:00:00+02:00 Copyright (c) 2026 Laura Fernández Sánchez https://reunido.uniovi.es/index.php/ridrom/article/view/24072 The Financing of Roman Theatre and Its Influence on Roman Political Life 2025-12-22T16:12:00+01:00 Belén Fernández Vizcaíno josefabele@telefonica.net
This paper examines the legal status of Roman theatre within the framework of public law, from its classification as res in publico usu to its later qualification as res universitatis, that is, collectively owned property intended for common use. It analyses the evolution of its legal regime from the Republican period to Justinianic law, with particular attention to the categories of public property and their administration. The study also explores the origins and development of theatre in Rome in its architectural, cultural, and religious dimensions, highlighting Greek and Etruscan influences. Special attention is devoted to the financing of the theatres of Pompey, Marcellus, and Balbus as expressions of evergetism and political propaganda, linked to personal prestige and aristocratic competition. Finally, the paper emphasises the role of theatre as a space of political communication, social cohesion, and symbolic construction of power in ancient Rome.
2026-04-23T00:00:00+02:00 Copyright (c) 2026 Belén Fernández Vizcaíno https://reunido.uniovi.es/index.php/ridrom/article/view/24086 Origin and Content in Roman Law of the Suppositio Partus or the Crime of a Supposititious Birth (Current Article 220.1 of the Spanish Criminal Code, Organic Law 10/1995, of November 23) 2026-01-07T20:54:57+01:00 María Olga Gil Garcia ogil@ubu.es
The present study examines the origins and development of the offence of suppositio partus in Roman law, from its initial formulation under the Lex Cornelia Testamentaria Nummaria of 81 BC to its subsequent evolution in Justinianic law. Taking as its starting point the specific difficulties inherent to the discipline—arising from the complexity of legal sources, the plurality of historical legal orders, and the need to contextualize institutions and legal concepts—the study explores the value of visual representation as a form of cognitive mediation aimed at fostering a structured understanding of historical law.

The paper also addresses the role of generative artificial intelligence as a technical support tool in the design of teaching materials, particularly in the creation of infographics and visual resources. In this regard, it emphasizes the importance of maintaining critical supervision by academic staff and of preserving the historical-legal method. Alongside the opportunities offered by these tools, the paper analyzes their risks and limitations, including excessive simplification, anachronism, and uncritical or decontextualized interpretations of visual representations in the teaching process.

Finally, the paper is complemented by the experience developed within a Teaching Innovation Project at the University of Valladolid, which allows for an assessment of the reflective integration of visualization and artificial intelligence into the teaching of History of Law, without undermining academic rigor or the methodological tradition of the discipline.
2026-04-23T00:00:00+02:00 Copyright (c) 2026 Nerea Hernanz Montalvillo https://reunido.uniovi.es/index.php/ridrom/article/view/24158 Women and Wine in Ancient Rome: What the Law Did Not Forbid 2026-02-15T15:38:38+01:00 Carmen Lázaro Guillamón mclazaro@uji.es
This work analyzes literary, epigraphic, and legal sources with the aim of discerning the nature of the prohibition on women drinking wine, the connected ban regarding women holding the keys to the cellar, and the related restrictions: dedicating themselves to its production and trade in Ancient Rome. In general, the legal character of these restrictions is assumed, but an exhaustive analysis reveals greater complexity. The literary sources allude to moral and social disapproval, since the cited leges of Numa and Romulus pose a legal significance that is perhaps imprecise. Epigraphy provides evidence of female participation in the production and trade of wine, which implies its consumption. The Corpus Iuris also does not seem to include a universal and explicit prohibition. Therefore, it appears that wine, a product of daily consumption and characteristic of Roman nature and society, also includes women.
2026-04-23T00:00:00+02:00 Copyright (c) 2026 Carmen Lázaro Guillamón https://reunido.uniovi.es/index.php/ridrom/article/view/24299 Marriage, Family and Wealth: The Dowry as a Mechanism for Social Consolidation of the Bond 2026-03-01T12:44:00+01:00 Marina marina.martin@ui1.es
This article analyses the legal status of women in Roman times based on an analysis of the institutions of marriage and dowry. First, it offers an overview of marriage as a historical and legal reality, emphasizing its institutional nature and its capacity to generate a set of reciprocal rights and duties between spouses. From this perspective, marriage is presented not only as a social fact, but also as a relationship with normative relevance, which can be analyzed—in functional terms—in light of categories similar to legal transactions, insofar as it produces effects and establishes legal positions within the family sphere.

Secondly, the article focuses on the dowry as a patrimonial mechanism associated with the marital bond. The analysis argues that the dowry did not operate, strictly speaking, as a constituent element or requirement for the validity of the marriage, but rather that the dowry negotiation was a key part of the family agreement between the future spouses, so that the dowry came to function as a social and economic prerequisite for the effectiveness of the marital project. Consequently, the dowry played a practical role in “consummating” the legal transaction represented by the marriage union, as it materialized its economic dimension, ensured its sustainability, and formalized family expectations, to the point of becoming a central part of the pre-marital negotiations. At the same time, we can see how the mechanisms for the restitution and protection of dowry assets evolved, protecting women and promoting female financial autonomy, especially among women of high social class.
2026-04-23T00:00:00+02:00 Copyright (c) 2026 MARINA Martín Moro https://reunido.uniovi.es/index.php/ridrom/article/view/24218 Paterfamilias and Pater Patriae: Intersections of Public and Private Authority in Roman Law 2026-01-30T19:12:33+01:00 Eva María Polo Arévalo eva.polo@umh.es
This work analyzes the parallels that existed in Roman law between the power exercised in the private sphere of the family and in the public sphere of the civitas. Authority was exercised in both spheres in a similar manner, serving jurists and literary authors as a reciprocal paradigm of power. This evolution culminated in the projection of the figure of the paterfamilias into the public sphere, where the title of pater patriae was adopted by important political figures to present themselves to society as protectors of the citizens.
2026-04-23T00:00:00+02:00 Copyright (c) 2026 EVA MARIA POLO ARÉVALO https://reunido.uniovi.es/index.php/ridrom/article/view/24254 Manumissions and Census in Light of “Fragment B” of Book IX of the Responsa of Papinian 2026-02-06T11:34:06+01:00 Gema Polo Toribio gema.polo@uclm.es
Abstract

The so-called “Fragment B” of Book IX of Papinian’s Responsa constitutes a key source for the study of manumissions and the persistence of the census populi in the 3rd century AD. It analyses its historical foundations, as well as its relationship with the exclusion of furtum in certain cases. The study distinguishes between fiducia cum amico and fiducia cum creditore, with particular attention to situations in which the secured debt had not yet been extinguished. It also identifies the circumstances in which usureceptio did not apply, especially where the fiduciant unlawfully seized the object through violence, clandestine conduct, or in breach of the fiduciary’s right of retention. The analysis shows that this institution did not aim to modify the general system of usucapion, but rather to provide exceptional protection consistent with the coherence of Roman law.

2026-04-23T00:00:00+02:00 Copyright (c) 2026 Carlos Varela Gil
