EL DERECHO ANTE EL NUEVO PARADIGMA TRANSHUMANISTA DE LA ERA DIGITAL

Abstract

The main aim of this article is to present a theoretical alternative
to the dominant doctrine of justechnicism (whose postulates are in
accordance with the foundations of legal formalism and the normativist view of
law). This alternative is embodied in the defense of technological humanism,
whose integrative plan makes it possible to reconcile scientific-technological
progress with the values and principles of humanist culture that make up the
enlightened project of modernity.

With regard to the transhumanist paradigm, one might ask what ethical-legal
implications legal Artificial Intelligence and robotics could have as spearheads
of the digital revolution in the cultural, academic and professional field
of law. In order to find a satisfactory answer to this question, I will refer to the risks that the still scarce existing regulation on legal Artificial Intelligence and
robotics may entail, as well as the impact of technological innovation on the
practice of law and on the market for legal services.
