Resumen.
Las uniones extramatrimoniales constituyen un modelo de familia al margen del matrimonio que como tal, gozan actualmente de igual protección constitucional que las concebidas bajo el instituto matrimonial y, pese a existir desde la Antigüedad, no siempre gozaron de la protección jurídica que hoy disfrutan.
Ante la ausencia de reglamentación común en todo el territorio nacional, el legislador autonómico se ocupó con más o menos detalle de este fenómeno, en función de sus competencias. Por tanto, actualmente, en nuestro país conviven las uniones extramatrimoniales formalizadas con las puramente fácticas.
Nuestra reflexión se ciñe a plantearnos, por un lado, si una regulación absoluta de las uniones extramatrimoniales les privaría de su propia esencia; por otro, sí es preciso abordar en el plano normativo algún aspecto de ellas con el fin de proteger al conviviente perjudicado por la ruptura -o a terceros- y por último, si debe dejarse libertad absoluta al individuo para autorregularse en el desarrollo de su autonomía privada en este aspecto.
Abstract.
Extramarital unions are family models outside marriage which have the same constitutional protection than the ones conceived in it, and although they have existed from ancient times, not always have had the legal protection they have nowadays.
In the absence of common regulation in all the national territory, the autonomous registrator attended to this matter in some details according to their competences. Therefore, nowadays extramarital formalized unions and purely factual ones live together in our country.
Our deliberation seeks to ask on the one hand if the absolute regulation of extramarital unions would prevent them of their own essence. On the other hand, we should know if it is necessary to approach in the legal framework some aspects of them to protect the convenient injured parties for the breaking or the other people. Finally we have to give absolute absolute freedom to the individual for self-regulating in the development of his autonomy denied in this espect.
