Abstract
The so-called “Fragment B” of Book IX of Papinian’s Responsa constitutes a key source for the study of manumissions and the persistence of the census populi in the 3rd century AD. Discovered in 1882 and initially reconstructed by Dareste, the fragment has been the subject of multiple doctrinal interpretations, from Esmein to contemporary Roman law scholarship. The core of the debate focuses on the validity of manumissions carried out by an incensus before the commission of a crime and on the possible extension of the poenae incensorum to the freed individuals.
