Abstract

Senatus Consultum Tertuliano and Orphiciano modified the principles governing the Roman inheritance statutes adding greater weight to the cognatio; as a result of this regulation, ius adcrescendi was applied normally in the last stages of the classic age as well as in the post classic period, in reason of superior juridical principles, bearing the same characteristics as in ancient law: ipso iure, etiam ignoranti et invito herede, portio portionio adcrescit, non personae..
