Abstract

The Roman aequitas —as a synonymous of the exact and just thing- has it antecedent in the Greek epiqueya but has also a reflection in the canonical aequitas, the Anglo-Saxon —and northamerican- equity and, in general, in the contemporary legal systems. For that reason the aequitas (fairness) has a great importance whenever the application of a legal norm becomes impossible or extremely unjust; and specially in those systems that are in formation or that containt abundant lagoons in the legal ordering. In the present work we will make a brief exam and analysis of the roman aequitas and of the relations, differences, similarities and influences with the equity..
