This work seeks to analyse the reception of the praesumptio muciana into both historical and current Spanish law, first examining the Roman legal sources that reference the presumption: a text by POMPONIUS found in the Digest, D. 24, 1, 51, and a rescript by Emperor SEVERUS ALEXANDER, found in C. 5, 16, 6..
