Rome and water resources

Abstract

The study presents a coherent framework of the "natural" water resources (sea, inland water, rivers and fluvial phenomena) and its legal regime in the Roman law. The work instead of a chronological order follows the order by subject, since the data available mostly from the archaic age are few and always exposed by authors very later than the facts that narrate. The discipline of the use of public waters was adapted to that of the other res publicae that the Roman State considered destined for the common use of the community. We do not speak of a system of concessions of use understood as acts of government, but of procedures to facilitate that each one uses the waters according to their needs without hindering or impeding the free use of others..
